Welcome to Unbreakable By Design (UBD)!

By accessing our website or purchasing our products, you agree to these Terms of Service and our applicable store policies.

Please review these terms carefully before placing an order.

1. Products & Custom Orders

Unbreakable By Design LLC specializes in custom apparel, DTF (Direct-to-Film) transfers, personalized merchandise, and other specialty products.

Many of our products are made specifically for each customer after an order is placed.

  • Production and processing times may vary depending on the product, order quantity, and customization requirements.

  • Standard order processing typically takes 2–4 business days, unless otherwise stated.

  • Custom orders may require additional production time.

  • Once production has begun, orders cannot be canceled or modified for a change of mind, except where required by applicable law.

We reserve the right to decline orders that contain prohibited, unlawful, or infringing content.

2. Customer-Provided Artwork & DTF Printing

When uploading artwork, logos, images, or designs for custom DTF printing, customers are responsible for ensuring that all submitted files are accurate and suitable for production.

Customer Responsibilities

  • Submit clear, high-resolution artwork.

  • Verify spelling, dimensions, design placement, and image quality.

  • Ensure that artwork is properly formatted according to product requirements.

  • Review all customization details before completing checkout.

Print Quality

The quality of the finished transfer depends on the quality of the submitted artwork.

UBD does not automatically enhance, redraw, correct, or modify customer-submitted files unless that service has been specifically requested and agreed upon.

We are not responsible for pixelation, blurriness, or other print-quality limitations caused solely by unsuitable customer-provided files when those limitations were adequately disclosed.

Minor color differences may occur due to variations in screen settings, printing materials, and production methods.

3. Copyright & Customer Artwork Rights

Customers who upload or submit designs for printing represent that they own the artwork or have the necessary permission, license, or authorization to reproduce it.

By submitting artwork, customers grant UBD a limited license to reproduce and process the submitted design solely for fulfilling their order and related production needs.

Customers agree not to submit material that unlawfully infringes another party's intellectual property rights.

UBD reserves the right to reject artwork that appears to violate copyright, trademark, or other applicable laws.

Customers may be responsible for losses arising from their unauthorized use of third-party intellectual property, to the extent permitted by law.

4. Pricing & Payments

All prices are displayed in U.S. dollars unless otherwise stated.

UBD accepts approved payment methods available at checkout, which may include:

  • Major credit and debit cards

  • Afterpay

  • Affirm

  • Venmo

  • Cash App

  • Other supported payment methods

Cash payments may be accepted for eligible local transactions arranged directly with UBD.

Buy Now, Pay Later Purchases

Orders placed using Afterpay or Affirm remain subject to our Refund & Return Policy and applicable consumer protection laws.

Using an installment payment service does not automatically make custom or final-sale merchandise eligible for a change-of-mind return.

Approved refunds will be processed according to the payment provider's procedures.

Customers are responsible for complying with their payment provider's installment agreement.

UBD does not control financing approvals, payment schedules, late fees, or decisions made by third-party payment providers.

5. Final Sales, Returns & Exchanges

Due to the custom and made-to-order nature of many UBD products, custom-made and personalized purchases are final sale, except where an item is defective, damaged, incorrect due to our error, or a remedy is required by law.

We do not accept change-of-mind returns or exchanges for:

  • Incorrect sizes selected by the customer

  • Customer-submitted artwork or spelling errors

  • Changes in personal preference

  • Items no longer needed for a particular occasion

  • Custom products accurately produced according to approved specifications

Damaged, Defective, or Incorrect Orders

Customers are requested to report issues within 3 calendar days of delivery.

Please email unbreakablebydesignn@gmail.com with your order number, a description of the issue, and supporting photographs.

If the claim is approved, UBD will provide an appropriate resolution, which may include a replacement or refund.

The reporting period does not limit any rights or remedies available under applicable law.

6. Shipping & Delivery

UBD offers the following domestic shipping options:

Rush Hustle Priority — $12.99

  • Advertised timeframe: 1–2 business days

UBD Standard — $6.99

  • Estimated timeframe: 5–8 business days

Free Domestic Shipping — Orders $75+

  • Estimated timeframe: 5–8 business days

Shipping eligibility, rates, and available services are confirmed at checkout.

Important Shipping Information

  • Processing time and carrier transit time are separate.

  • Delivery estimates are not guaranteed arrival dates unless an express guarantee is provided.

  • Once a package is accepted by the shipping carrier, transportation and delivery scheduling are outside UBD's direct control.

  • Carrier-related delays do not automatically qualify an order for a refund.

  • Customers are responsible for providing accurate shipping information.

If a package is lost, significantly delayed, or damaged during transit, customers should contact UBD for assistance.

Nothing in these terms limits remedies required under applicable law.

7. Order Accuracy & Customer Responsibilities

Customers are responsible for reviewing their order details before completing checkout.

This includes:

  • Product selections

  • Clothing sizes and colors

  • Customization requests

  • Uploaded artwork

  • Shipping addresses

  • Contact information

UBD is not responsible for errors caused solely by incorrect customer-provided information when an order is fulfilled accurately according to the submitted details.

If you notice an error after placing your order, please contact us immediately.

Changes cannot be guaranteed once production has begun or an order has shipped.

8. Product Appearance & Color Variations

We make every effort to display our products as accurately as possible.

However, actual product colors may vary slightly due to:

  • Device screen settings

  • Lighting conditions

  • Printing techniques

  • Fabric types and textures

  • Material availability

Minor variations that fall within disclosed product specifications are not automatically considered manufacturing defects.

This does not affect your rights regarding products that are materially different from their descriptions or otherwise defective.

9. Intellectual Property & Website Content

Unless otherwise indicated, original UBD branding, logos, graphics, photographs, product descriptions, and website content are owned by or licensed to Unbreakable By Design LLC.

Unauthorized reproduction, distribution, resale, or commercial use of UBD-owned intellectual property is prohibited without prior written permission.

Customer-submitted artwork remains the property of its respective rights holder.

10. Memberships & Subscription Services

If UBD offers memberships or subscription-based products, the applicable membership terms, pricing, billing frequency, benefits, and cancellation conditions will be disclosed at enrollment.

Membership benefits may include eligible shipping discounts or other promotional offers.

Subscription renewals and cancellations are governed by the terms presented at enrollment and applicable law.

UBD will not impose recurring charges without the customer's required authorization.

11. Order Refusal & Fraud Prevention

UBD reserves the right to review, decline, or cancel orders for legitimate reasons, including:

  • Suspected fraudulent activity

  • Unauthorized payment transactions

  • Prohibited or unlawful artwork

  • Product unavailability

  • Material pricing or listing errors

If an order is canceled after payment has been collected, any refund owed will be issued to the original payment method.

12. Website Availability & Third-Party Services

We strive to keep our website accurate, secure, and available.

However, we cannot guarantee uninterrupted access or that all website content will always be free from technical errors.

Certain services, including payment processing, shipping, and installment financing, are provided by third parties.

Those services may be governed by their own terms and conditions.

13. Limitation of Liability

To the extent permitted by applicable law, UBD is not responsible for indirect or consequential losses resulting solely from circumstances outside our reasonable control, including third-party shipping disruptions or service interruptions.

Nothing in these Terms of Service excludes or limits liability that cannot legally be excluded or limits a customer's statutory consumer rights.

14. Governing Law

These Terms of Service are governed by the laws of the State of California, United States, subject to applicable consumer protection laws and mandatory legal requirements.

15. Changes to These Terms

UBD may update these Terms of Service periodically to reflect changes in our business operations, products, policies, or legal requirements.

Updated terms will be posted on this page with a revised effective date.

Changes will not retroactively remove rights customers have already acquired under applicable law.
